AN ACT to amend the civil practice law and rules, in relation to expenses in matrimonial actions

Specifically, the bill applies to divorce actions, custody and visitation cases, and post-divorce proceedings. To qualify for this presumption, the bill requires the invoice to be accompanied by an affirmation from the service provider stating that the goods or services were actually provided, no refunds will be issued, and the charges represent the usual and customary rates. Additionally, the party introducing the bill must serve a copy of the invoice and a notice of intention to the adverse party at least 30 days before trial. The adverse party can challenge the invoice by filing a written notice of objection at least 15 days before trial. The bill will take effect 60 days after becoming law and will apply to matrimonial actions commenced on or after that date.
