This bill provides a heart disease presumption for probation officers working in cities with a population of one million or more, specifically New York City. Under the proposed legislation, if a probation officer, supervising probation officer, or probation officer trainee develops a heart-related health impairment that results in total or partial disability or death, and they previously passed a physical examination that did not reveal any heart condition, the impairment will be presumed to have occurred in the line of duty unless proven otherwise. Additionally, if such an officer retires due to this heart-related disability, they will receive a pension equal to three-quarters of their final average salary. The bill applies specifically to New York City's probation department and will impact Tier 4 and Tier 6 members of the New York City Employees' Retirement System (NYCERS). All past service costs associated with implementing this legislation will be borne by the City of New York, and the act will take effect immediately upon passage.
