This bill, the Modernizing Access to Our Public Oceans Act, aims to improve how information about public recreational use of federal waterways is shared. It requires the Secretary of Commerce to develop standards for coordinating and distributing data related to fishing restrictions, which are rules limiting fishing in federally managed areas, and how recreational vessels, like boats used for leisure, can use the exclusive economic zone, a U.S. maritime area extending 200 nautical miles from shore. Within four years, the Secretary must make geographic information system (GIS) data publicly available on a website, detailing fishing restrictions, areas open or closed to recreational activities, restrictions on vessel propulsion, and information about federal marine protected areas. This data will also include navigation and depth information for the exclusive economic zone. The website must be user-friendly, allowing for easy updates and public comments, and the data will be updated regularly, with real-time updates for certain information. However, sensitive information about historical resources or commercial fishing will not be disclosed, and the act does not apply to tribal waters. The Secretary is also authorized to partner with various non-federal entities, including states, Indian Tribes, Native Hawaiian organizations, and nonprofit organizations, and must coordinate with other federal agencies to ensure data compatibility. Importantly, the bill clarifies that it does not alter existing definitions of navigable waters, agency jurisdictions, or tribal rights.
