Bill Summary

AN ACT to amend the retirement and social security law, in relation to providing a disability presumption to members of public retirement systems

AI Summary

This bill proposes to amend the Retirement and Social Security Law to create a disability presumption for members of public retirement systems in New York State. Specifically, it states that if a member of a public retirement system has been determined to have a permanent partial disability by the New York State Workers' Compensation Board, or if the United States Social Security Administration has determined they are disabled for substantial gainful activity and approved them for Social Security disability benefits, they will automatically be considered disabled for the purposes of eligibility for disability benefits from their public retirement system. This change aims to streamline the disability benefit application process for those who have already met disability criteria through other state or federal programs.
