Bill Summary

AN ACT prohibiting the diminution of retiree health benefits by a public employer

AI Summary

This bill, effective January 1, 2027, prohibits public employers, defined as professional police and fire fighters in New York State, from reducing the health insurance benefits or the employer's contributions towards those benefits for retirees and their dependents below the level they were at when the retiree retired. Importantly, this act does not override any existing collective bargaining agreements, and it clarifies that public employers who do not currently offer retiree health benefits are not required to start doing so. For retirees from positions not covered by collective bargaining agreements, their benefits and contributions will be protected at the level provided to active employees in similar positions at the time of their retirement.
