This bill amends the New York State Executive Law to clarify and expand employer liability for discriminatory practices by employees or agents. Specifically, the bill establishes three scenarios where an employer can be held responsible for discriminatory conduct: first, when the discriminatory act is committed by an employee with managerial or supervisory responsibilities; second, when a non-managerial or non-supervisory employee commits a discriminatory act and the employer either knew about it through supervisory staff, acquiesced to the conduct, or failed to take immediate corrective action; and third, when the employer should have known about the discriminatory conduct through reasonable diligence and did not take steps to prevent or stop it. The bill aims to hold organizations more accountable for preventing discrimination by creating clearer standards for organizational responsibility, regardless of the employee's level in the company hierarchy. The new provisions will take effect 180 days after becoming law, giving employers time to review and adjust their policies and practices to comply with the expanded liability standards.
