This bill expands disability retirement benefits for members of the New York City Teachers' Retirement System (NYCTRS) who participated in World Trade Center (WTC) rescue, recovery, or cleanup operations after the September 11, 2001 attacks. Specifically, active NYCTRS members who were involved in these operations and have been determined to have incurred a "qualifying World Trade Center condition" as a result of their service will now be eligible for a duty disability retirement allowance equal to three-quarters of their final average salary. The bill amends existing retirement and social security laws to include NYCTRS members alongside other retirement systems (such as the New York State and Local Employees' Retirement System and the New York State Teachers' Retirement System) in receiving these enhanced benefits. The condition must be determined to have been incurred in the performance of duty and be the natural and proximate result of an accident not caused by the member's own willful negligence. The act takes effect immediately and applies retroactively to NYCTRS members who meet these criteria, recognizing the significant health risks faced by those who responded to the WTC site in the aftermath of the 9/11 terrorist attacks.
