This bill establishes new rules for communications between the Texas Commission on Environmental Quality (TCEQ) and government officials regarding permit applications. Specifically, the governor, lieutenant governor, or state legislators can now communicate in writing, including electronically, with TCEQ commissioners about pending permit applications. Legislators are limited to discussing applications for facilities in their own districts. When such communications occur, the TCEQ must include the communication in the official record and provide an opportunity for other parties to respond. The bill includes important ethical safeguards: government officials cannot communicate about permit applications involving businesses in which they or their close relatives have a substantial financial interest. The TCEQ is also authorized to set reasonable deadlines for such communications. The provisions will take effect on September 1, 2025.
