This bill amends the Michigan Zoning Enabling Act by removing a specific provision related to renewable energy projects and zoning regulations. Currently, the law requires zoning ordinances to comply with several state acts, including those related to electric transmission lines, regional transit, and small wireless communications facilities. The bill specifically removes the requirement that zoning ordinances be subject to Part 8 of the Clean and Renewable Energy and Energy Waste Reduction Act. The bill also eliminates a provision that previously protected renewable energy projects that received special land use approval on or after January 1, 2021, which would have been considered a prior nonconforming use if substantial construction or a minimum expenditure had occurred. The bill maintains other existing provisions about natural resource extraction, allowing local governments to regulate such activities while ensuring that valuable natural resources can be extracted unless doing so would result in very serious consequences. Importantly, the bill will only take effect if Senate Bill No. 322 is also enacted into law, creating a legislative tie-bar between the two bills.
