This bill amends the Immigration and Nationality Act to expand the government's authority to expeditiously remove certain immigrants who are deemed inadmissible. Specifically, the bill gives the Secretary of Homeland Security broader discretion to apply expedited removal procedures to any alien (non-citizen) who is inadmissible under certain immigration law provisions, without previous limitations. The bill changes the standard for determining whether an immigrant can be expeditiously removed from "a significant possibility" of eligibility for asylum to "clear and convincing evidence", which is a higher legal standard. Additionally, the bill replaces references to the Attorney General with the Secretary of Homeland Security as the implementing authority, and removes previous exemptions that limited the application of expedited removal. These changes would essentially make it easier for the Department of Homeland Security to quickly remove immigrants who do not meet specific entry requirements, with the Secretary having sole and unreviewable discretion in applying these procedures.
