This bill amends Delaware law to establish comprehensive criminal background check requirements for Department of Education employees, prospective employees, contractors, and third parties who may access student records. Specifically, current and prospective Department of Education employees must submit fingerprints and other necessary information to obtain state and federal criminal history record information from the State Bureau of Identification and the Federal Bureau of Investigation. Contractors and third parties who might access student records may also be required to undergo background checks at the Secretary's discretion. The bill mandates that the State Bureau of Identification forward all obtained criminal history information to the Department of Education and provide ongoing updates through the Rap Back System (a continuous monitoring system for criminal record changes). The Department of Education is granted the right to review and use this criminal background information when evaluating an individual's qualifications for employment or continued access to departmental systems, facilities, or data. Current employees and contractors must submit the required background check information within 30 days of receiving a written request from the Department, ensuring a comprehensive and ongoing approach to screening personnel who work with or near students.
