This bill modifies the Small and Certified Business Enterprise Development and Assistance Act of 2005 to strengthen requirements and procedures for certified business enterprises (CBEs) in the District of Columbia. The bill introduces new definitions, such as "independently owned and operated," which means a business manages its daily operations without control or restriction from another business entity, and clarifies what constitutes a "material change" that must be reported to the Department of Small and Local Business Development within 30 days. The legislation updates certification requirements for local business enterprises, including provisions that a business must be independently owned, more than 50% owned by a District-based enterprise, or owned by a non-District business with majority District resident ownership. The bill also establishes more rigorous requirements for certified joint ventures, mandating that each certified business enterprise perform work equal to its percentage interest in the venture and subcontract at least 35% of work to certified businesses. Additionally, the bill creates uniform hearing procedures for enforcement actions, allowing businesses to request hearings before the Office of Administrative Hearings if their certification is threatened, and establishes a process for potential suspension, revocation, and potential reinstatement of certifications, including a 36-month waiting period for businesses whose certifications are revoked.
