This bill, known as the ANTE Act (Axing Nonmarket Tariff Evasion Act), empowers the United States Trade Representative to investigate and take remedial measures against entities from nonmarket economy countries that attempt to evade trade duties by establishing investments in third countries. The bill allows the Trade Representative to initiate inquiries into whether a "covered entity" (defined as an entity owned, controlled, or substantially owned by a nonmarket economy country) is creating investments in other countries specifically to avoid paying duties. If such an evasion attempt is found, the Trade Representative can impose remedial measures, including duties equal to or greater than the original tariffs, on goods produced by these entities. The bill applies to countries classified as nonmarket economies and on the Special 301 Priority Watch List, and provides a mechanism for the Trade Representative to investigate such potential evasions either through self-initiation or upon request by interested parties or Congress. The remedial measures can be applied both to ongoing production and prospective investments, and will remain in effect as long as the original trade action against the nonmarket economy country is in place or the country maintains a controlling interest in the third-country investment.
