Bill Summary

This bill allows a political subdivision to regulate pesticides for the purpose of protecting pollinators and pollinator habitats. Current law prohibits a political subdivision (a city, village, town, or county) from prohibiting the use of or otherwise regulating pesticides but provides numerous exemptions. For example, a political subdivision may enact an ordinance that regulates pesticides pursuant to a storm water management program or that relates to the storage, treatment, or disposal of solid waste that contains pesticides. The bill adds an additional exemption that allows a political subdivision to regulate pesticides in order to protect pollinators and pollinator habitats. XPollinatorY is defined in the bill as an insect that pollinates flowers.

AI Summary

This bill allows local governments (such as cities, towns, counties, and villages) to create regulations specifically aimed at protecting pollinators and their habitats by using pesticide restrictions. Currently, local governments are generally prohibited from regulating pesticides, with some existing exemptions. The bill adds a new exemption that explicitly permits political subdivisions to enact ordinances that protect pollinators, which are defined as insects that pollinate flowers. This means a local government could, for example, restrict certain pesticide uses in areas with significant pollinator populations or important pollinator habitats, even if those restrictions would not have been allowed under previous law. The provision is designed to give local authorities more flexibility in protecting important insect populations that play a critical role in ecological and agricultural systems by enabling local governments to take proactive measures to preserve pollinator health.
