This bill provides a presumption for accidental disability benefits for certain deputy sheriff members in the sheriff's department of a city with a population of one million or more, specifically those employed by the New York City Employees' Retirement System (NYCERS). If these deputy sheriffs contract Human Immunodeficiency Virus (HIV), tuberculosis, or hepatitis while performing their duties, it will be presumed that they contracted the disease as a direct result of an accidental injury sustained in the line of duty, unless proven otherwise. This presumption is intended to simplify the process for these law enforcement officers to receive disability retirement benefits, which would be calculated as three-quarters of their final average salary, a significant increase from current ordinary disability retirement benefits. The bill also addresses performance of duty death benefits, which would be a lifetime benefit of 50% of the member's last year's wages, plus potential additional benefits.
