This bill authorizes the Division of Capital Asset Management and Maintenance (DCAMM) to grant permanent and perpetual easements to the City of Lowell for three specific parcels of land totaling approximately 6,750 square feet, located along the Merrimack River. The easements are specifically for constructing, maintaining, accessing, operating, replacing, repairing, patrolling, abandoning, and removing outfall structures and mainline drains on land currently under the care and control of the Department of Conservation and Recreation (DCR). The city must compensate the Commonwealth either through improvements to nearby DCR property or through a cash payment equal to the full market value of the land, as determined by an independent appraisal. The appraisal must be reviewed by the Inspector General, who will submit a report to legislative committees. The easement includes a provision that if the City of Lowell no longer uses the land for the specified purposes, the easement will revert back to the Commonwealth under DCR's control. Additionally, the city must restore any disturbed surface areas to their original or better condition, and the easement is subject to terms and conditions prescribed by DCAMM and DCR.
