This bill amends several New York state laws to create a new electronic service of process option specifically for government entities (state, city, town, village, or other political subdivisions) when serving legal documents on various types of business entities like corporations, associations, limited liability companies, partnerships, and boards of managers. Under this new provision, government entities can electronically submit process documents to the Department of State through an electronic system, along with any required statutory fees. When this electronic service occurs, the secretary of state will review and accept the service, then promptly either: (1) send a copy of the process by certified mail to the entity's registered address, or (2) email a notice that process has been electronically served and make the document available to the entity. The bill ensures that this electronic service method is available at no extra cost to consumers and will become effective 180 days after becoming law. This change modernizes the service of process by introducing a digital option for government legal communications, making the process potentially faster and more efficient.
