This bill amends Michigan's Revised Judicature Act to establish a process for individuals to seek relief from federal firearms disabilities related to mental health adjudications or commitments. The bill requires courts to forward specific identifying information to state police when an individual becomes subject to firearm restrictions under federal law (18 USC 922(d)(4) or (g)(4)), and mandates that the individual be notified of these restrictions. Individuals can petition the court where their original adjudication or commitment occurred to remove their firearms disabilities, with the court required to consider evidence about the circumstances of the disability, the petitioner's mental health and criminal history, character, and changes in their condition. The court must grant relief if it finds by a preponderance of the evidence that the petitioner is not likely to be dangerous to public safety. If relief is granted, the court must notify state police, who must then update relevant databases within 10 business days. The bill limits petitions to once every two years and prohibits petitions for those currently committed to mental health facilities. The process is designed to provide a structured method for individuals to potentially regain their firearms rights while maintaining public safety considerations.
