This bill amends the Infrastructure Investment and Jobs Act to modify the Build America, Buy America Act by expanding the definition of construction materials to include yellow organic pigments. Specifically, the bill requires that for a yellow pigment to be considered a US-made construction material, all manufacturing processes - from initial material combination through the chemical reaction creating the synthesized pigment - must occur within the United States. The chemical reaction is defined as a process that creates a molecule with a new structure by breaking and forming intramolecular bonds or altering the spatial arrangement of atoms. The amendment will apply to yellow pigments used in water-based paints for road, highway, and airport surface markings, with immediate effect for pigments used in such applications and a two-year implementation period for pigments included in existing formulas. The bill also requires the Director of the Office of Management and Budget to update relevant guidance within 90 days of enactment to reflect these new requirements. The legislation, titled the "Paving the Way for American Industry Act," aims to support domestic manufacturing by creating stricter standards for what qualifies as an American-made construction material.
