This bill establishes new notification requirements for health insurance policies involving older adults (defined as individuals 60 years of age or older) in Pennsylvania. The legislation requires insurers to ask older adults during enrollment whether they have a power of attorney for health care decisions, and if so, to request the agent's contact information. When an older adult enrolls in or cancels a health insurance policy with an appointed agent, the insurer must notify that agent in writing and send a copy of the notification to the older adult. The notification must explain a 30-day rescission period during which the older adult can cancel or rescind the policy enrollment without penalty. The bill provides insurers with a good faith defense against legal action if they rely on information provided by the older adult. These requirements do not apply if the older adult has revoked their power of attorney and notified the insurer. The new provisions will take effect 60 days after the bill's passage and will apply to health insurance policy enrollments and cancellations occurring after that date.
