This bill amends Title 10 of the Delaware Code concerning interpersonal and sexual violence, specifically by adding a definition for "military protective order," which is a protection order issued by a commanding officer in the armed forces or National Guard against a subordinate. The bill mandates that courts must consider evidence of an existing military protective order as a factor in favor of granting emergency protective orders in cases of domestic violence and emergency temporary sexual violence protective orders. Additionally, if a law-enforcement officer has probable cause to believe a service member has violated a military protective order registered in a national database, the officer must notify the agency that entered the order into the database. These changes are intended to strengthen protections for individuals experiencing violence and will take effect on January 1, 2027.
