Bill Summary
Current law provides that a federally licensed firearms dealer may not LRB-1276/1 CMH:klm 2025 - 2026 Legislature SENATE BILL 336 transfer a handgun after a sale until the dealer has performed a background check on the prospective transferee to determine if he or she is prohibited from possessing a firearm under state or federal law. This bill generally prohibits any person from transferring any firearm, including the frame or receiver of a firearm, unless the transfer occurs through a federally licensed firearms dealer and involves a background check of the prospective transferee. Under the bill, the following are excepted from that prohibition: a transfer to a firearms dealer or to a law enforcement or armed services agency; a transfer of a firearm classified as antique; or a transfer that is by gift, bequest, or inheritance to a family member. A person who is convicted of violating the prohibition is guilty of a misdemeanor and must be fined not less than $500 nor more than $10,000, may be imprisoned for not more than nine months, and may not possess a firearm for a period of two years. Because this bill creates a new crime or revises a penalty for an existing crime, the Joint Review Committee on Criminal Penalties may be requested to prepare a report. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.
AI Summary
This bill expands Wisconsin's existing firearm transfer regulations by requiring nearly all firearm transfers to go through a licensed firearms dealer and include a background check, with only limited exceptions. Specifically, the bill prohibits individuals from transferring firearm ownership unless the transfer is made through a licensed firearms dealer, occurs between dealers or to law enforcement agencies, or involves a transfer to a family member who is not prohibited from possessing a firearm. The bill broadens the definition of transfer to include selling, assigning, pledging, leasing, loaning, giving away, or otherwise disposing of a firearm, and now applies to all firearms, not just handguns. Individuals who intentionally violate these transfer requirements can be fined between $500 and $10,000, potentially imprisoned for up to nine months, and prohibited from possessing a firearm for two years. The bill also updates various related statutes to reflect these changes, including modifying background check procedures, record-keeping requirements, and references to firearm transfers across multiple sections of Wisconsin law. Exceptions to the transfer requirements include transfers of antique firearms, transfers between firearms dealers, and transfers to law enforcement or armed services agencies, as well as transfers to family members under specific conditions.
