This bill amends Delaware law to protect individuals injured in motor vehicle accidents by allowing them to rescind (cancel) a release of claim or settlement agreement signed within 30 days of the accident, provided they did not have legal representation at the time. The injured person has 15 days from signing the release or cashing a settlement check to rescind, and to do so effectively, they must provide written notice to the other party or their insurance carrier and return any settlement money received within 10 days after the rescission period ends. Insurance companies are permitted to hold back future settlement payments until confirmation of the return of funds is received, and any release signed within 30 days of an accident must clearly state the individual's right to rescind. This change aims to prevent individuals from feeling pressured into accepting settlements before fully understanding their injuries or rights.
