This bill amends Michigan's penal code to expand regulations concerning individuals wearing masks or face coverings. Currently, the law makes it a misdemeanor to wear a mask while intentionally concealing one's identity to facilitate a crime. The proposed bill adds two new provisions: First, it allows law enforcement officers to stop and request identification from an individual wearing a mask if that person is either attempting to threaten or intimidate others or is violating a law or local ordinance while masked. Second, the bill establishes that an individual who refuses to comply with an officer's request to remove their mask and provide identification can be charged with a misdemeanor, punishable by up to one year in prison, a fine of up to $2,500, or both. The original misdemeanor provision for wearing a mask to commit a crime remains unchanged, continuing to carry a penalty of up to 93 days in jail, a $500 fine, or both. The bill will take effect 90 days after being signed into law, potentially giving law enforcement additional tools to identify individuals wearing face coverings in potentially threatening or unlawful situations.
