This bill amends the Weights and Measures Act to allow for the sale of motor fuel by certain equipment rental companies to customers renting their equipment. Specifically, it permits "qualified equipment renters" (businesses primarily in the equipment rental industry, defined by specific industry codes and revenue from rentals) to sell motor fuel at "qualified equipment rental locations" (physical locations selling less than 3,000 gallons of motor fuel annually to renters) under two methods: either as a flat rate or surcharge clearly stated in the rental contract, or as a per-gallon fee also clearly stated in the contract, with the amount dispensed measured by a "qualified dispenser." A qualified dispenser is defined as a container holding 110 gallons or less of motor fuel, compatible with the fuel, meeting certain federal safety standards, and equipped with a dispensing hose and nozzle, a venting system, a fuel level gauge, and a volumetric flow meter that is accurately installed, displays fuel dispensed to the nearest 0.1 gallon or less, and is certified by the manufacturer to be within 1.0% accuracy. The bill also clarifies definitions for "gallon," "motor fuel," and "rent" or "rental," and specifies that qualified rental equipment is mobile equipment powered by motor fuel that is rented out, including various types of machinery and vehicles not typically driven on public roads.
