This bill proposes to modify existing law regarding liability for wrongful death of an embryo or fetus by removing several key exceptions to when a person can be held legally responsible for causing harm to a pregnant individual that results in miscarriage, stillbirth, or injury to the embryo or fetus. Specifically, the bill eliminates previous exemptions that protected individuals from liability in cases involving: (1) actions taken by the pregnant individual herself, (2) medical procedures performed by licensed healthcare professionals with consent (or in medical emergencies), and (3) the lawful dispensation or prescription of medication. The bill also removes the definition of "physician or other licensed health professional" from the statute. By eliminating these exceptions, the legislation appears to expand potential legal avenues for holding parties accountable for actions that result in harm to a pregnancy. The bill is officially referred to as the "justice for babies in the womb act" and amends a section of Michigan's Revised Judicature Act related to civil liability.
