This bill amends the "Youth Tobacco Act" to remove criminal penalties and civil sanctions for minors who purchase, possess, or use tobacco products, vapor products, or alternative nicotine products, as well as for presenting false proof of age for these purposes. Vapor products and alternative nicotine products are defined as any product containing nicotine that is not a tobacco product, including e-cigarettes. The bill specifically states that these provisions, which outline the prohibitions and penalties, will no longer apply after the effective date of the amendatory act that added this new subsection, effectively sunsetting these regulations. However, it clarifies that this does not prevent an individual from being charged with other violations of law that may arise from such actions. The bill also maintains exceptions for minors involved in approved undercover operations or compliance checks, and for those handling or transporting these products as part of their employment.
