Bill Summary

This bill amends "Daniel's Law," P.L.2021, c.371, concerning the privacy of home addresses of certain public officials, to provide an exemption for licensed land surveyors. Under "Daniel's Law," certain public officials such as judges, prosecutors, law enforcement officers, and child protective investigators, may request that their home addresses be redacted or withheld from disclosure from certain public records, such as property deeds and tax maps. However, the law provides for certain exceptions where the address is necessary to facilitate certain business transactions, such as mortgages and real estate sales. The Director of the Division of Taxation may promulgate regulations concerning the use of unredacted records in conformity with the privacy protections of "Daniel's Law." Under the bill, land surveyors licensed in this State or land surveying firms authorized to operate in this State would be allowed to receive unredacted records when requested in the ordinary course of business. The bill additionally allows the Commissioner of Banking and Insurance, the New Jersey Real Estate Commission, and the State Board of Professional Engineers and Land Surveyors to also promulgate regulations concerning the use of unredacted records in conformity with the privacy protections of "Daniel's Law."

AI Summary

This bill amends "Daniel's Law," which protects the privacy of home addresses for certain public officials, to provide an exemption for licensed land surveyors. Specifically, the bill adds professional land surveyors and land surveying firms to the list of entities that can receive unredacted property records when requested in the ordinary course of business. Currently, "Daniel's Law" allows some professionals like title insurance agents, mortgage loan originators, and real estate brokers to access unredacted records, and this bill expands that access to include licensed land surveyors. The bill also grants additional regulatory authority to the Commissioner of Banking and Insurance, the New Jersey Real Estate Commission, and the State Board of Professional Engineers and Land Surveyors to create guidelines for using unredacted records while maintaining privacy protections. The law will take effect on the first day of the third month following its enactment, with the State Board of Professional Engineers and Land Surveyors permitted to take preparatory actions in advance. This amendment ensures that land surveyors can effectively conduct their professional work while still protecting the home addresses of covered public officials.
