Bill Summary

Under this bill, if the secretary of administration determines that federal aid to Wisconsin that was previously authorized under an act of Congress is being withheld under an executive order of the president of the United States or in contravention of a court order, the secretary must do all of the following: 1. Determine the approximate amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order. 2. No later than 60 days after the date of the executive order or court order, submit a report to the governor and the legislature that describes in detail the amount of federal aid the state is being or is expected to be deprived of as the result of the executive order or contravention of the court order and identifies all moneys the state must pay to the federal government for any reason during the succeeding 12 months after the report is submitted. 3. Withhold the payment to the federal government of those identified moneys in a total amount not to exceed the approximate amount of federal aid the state is being or is expected to be deprived of. 4. Authorize the payment to the federal government of those withheld moneys upon the state[s receipt of all federal aid previously withheld under the executive order or in contravention of the court order. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill creates a new statute that provides a mechanism for the Wisconsin secretary of administration to respond if the federal government withholds previously authorized federal aid to the state through an executive order or by violating a court order. Specifically, the secretary must first determine the approximate amount of federal aid being withheld, then submit a detailed report to the governor and legislature within 60 days that describes the withheld aid and identifies all moneys the state is required to pay to the federal government in the next 12 months. The secretary is then authorized to withhold payments to the federal government up to the amount of the withheld federal aid. These withheld payments can only be released once the state receives all of the previously withheld federal aid. This bill appears to be a protective measure that allows Wisconsin to leverage its own payments to the federal government as a means of pressuring the restoration of previously authorized federal funding, essentially creating a financial negotiation mechanism in response to what the state might view as improper federal aid withholding.
