This bill provides a comprehensive mechanism for recalling elected officials in the town of Berkley, Massachusetts. The bill allows qualified voters to initiate a recall process against any elected town official, with some restrictions: no recall affidavit can be filed within the first or last 6 months of an official's term. The recall process begins when at least 25 registered voters file an affidavit stating the grounds for recall, after which the Town Clerk issues petition blanks. These petitions must be signed by at least 15% of registered voters from each precinct and returned within 20 business days. If the petitions are certified, the Town Clerk must notify the targeted official, who then has five days to resign. If the official does not resign, the Board of Selectmen must order a special recall election within 60-90 days. The recall election ballot will include a proposition to recall the official and a list of candidates, with the official being allowed to be a candidate to succeed themselves. If a majority votes to recall the official, the candidate with the most votes will be elected to complete the remainder of the term. The bill also includes a provision that prevents any recalled or resigned official from being appointed to a town office for two years following their removal or resignation.
