This bill aims to improve public safety in the trucking industry by requiring motor carriers (trucking companies) to submit positive hair drug test results to the Drug and Alcohol Clearinghouse maintained by the Federal Motor Carrier Safety Administration. Specifically, the bill mandates that trucking companies using vehicles weighing 10,000 pounds or more must promptly report positive hair drug test results from preemployment and random drug screenings. To ensure accuracy and reliability, these hair drug tests must be conducted by laboratories accredited by the College of American Pathologists for forensic hair drug testing and must incorporate Department of Health and Human Services scientific guidelines when possible. The tests must also be performed using a medical device that has been cleared by the FDA. Within one year of the bill's enactment, the Secretary of Transportation is required to develop regulations implementing these new requirements, including updating the existing definition of "actual knowledge" in federal regulations to explicitly include hair drug test results. The goal of this legislation is to enhance safety standards in commercial transportation by providing a more comprehensive method of tracking drug use among truck drivers.
