This bill, known as the Disposal of Waste Tires, Trash and Debris Act, allows municipalities to enforce their own rules and regulations regarding the improper disposal of waste, including waste tires and trash, and sets penalties for violations. Specifically, municipalities can impose fines of up to $5,000 for "short dumping," which is the act of knowingly depositing trash or debris on roads, land, or in waterways, and can also seize any vehicle used in such violations, regardless of its value. For the improper disposal of waste tires, municipalities can fine individuals up to $500 per tire. If a person is fined for short dumping, the municipality must notify the Department of Transportation, which will then suspend that person's driver's license for six months. Businesses that accept used tires for disposal or recycling are required to keep records of how many tires they receive and proof of their proper disposal for at least five years, making these records available to the municipality upon request. The fines collected by municipalities under this act are to be used for promoting recycling, expanding waste tire disposal programs, cleaning up improperly disposed waste, preventing future violations, and enforcing compliance with the act. This bill also clarifies that it does not invalidate any existing municipal ordinances related to waste disposal.
