This bill aims to improve the efficiency of investigations conducted by Diplomatic Security (DS) special agents by allowing the Assistant Secretary of State for Diplomatic Security or the Principal Deputy Assistant Secretary to pre-approve wiretap and communication interception authorizations, instead of requiring direct approval from the Secretary of State. Currently, DS agents must obtain the Secretary's pre-approval for each instance of recording communications during investigations, which the bill argues significantly delays and hampers law enforcement efforts. The legislation reflects Congress's belief that DS agents should have capabilities similar to other federal law enforcement agencies in conducting recordings to ensure accountability and public confidence. Specifically, the bill requires the Secretary of State to delegate pre-approval authority to the Assistant Secretary within 90 days of enactment, allowing DS special agents to more quickly obtain authorization for intercepting wire, oral, or electronic communications while conducting their official duties, in accordance with existing federal legal requirements. The Secretary must also update the Foreign Affairs Manual to reflect this new delegation of authority.
