AI Summary
This bill establishes a comprehensive employment verification system for state grantees, requiring all grantees, contractors, and subcontractors who receive state grants to use the federal E-Verify Program (EVP) to confirm the employment eligibility of new employees. The legislation creates a new framework that mandates grantees to complete a verification form confirming their enrollment in EVP and their commitment to verifying employee eligibility, with penalties for non-compliance. Violations can result in escalating sanctions, including warning letters for first-time offenses, temporary debarment from receiving state grants for repeated violations, and potential civil penalties ranging from $2,500 to $25,000. The bill also protects employees from retaliation if they report violations and establishes a Commonwealth Grantee Employment Verification Account to collect and manage penalties. Additionally, the legislation provides immunity for grantees who act in good faith when using EVP and specifies that no grantee can be held liable for the actions of their contractors or subcontractors. The law will take effect 60 days after its passage, giving organizations time to adapt to the new requirements and implement the necessary verification processes.
