This bill requires campgrounds in Texas to develop, adopt, and annually update a written flood disaster plan, which must be submitted to the Texas Division of Emergency Management (TDEM). The bill defines a campground as a property designed for transient guests to use tents, recreational vehicles, or camping equipment, and requires campground entities to post their approved plan in a conspicuous location or on their website, provide copies to staff and campers, and share the plan with local emergency services. TDEM will establish rules for the plan's content, submission process, and evaluation, with consideration given to potential financial hardships for campground owners. If a submitted plan is deemed insufficient, the campground entity must make changes within 90 days. The bill also introduces a civil penalty of up to $1,000 per violation, which can be enforced by the attorney general, with each day of non-compliance considered a separate violation. The implementation timeline allows campground entities until May 1, 2026, to submit their first flood disaster plan, and TDEM must adopt the necessary rules by March 1, 2026. The act will take effect immediately if it receives a two-thirds vote in the Texas Legislature, or otherwise 91 days after the legislative session ends.
