This bill creates a new law allowing the commissioner of state health services to issue a statewide order that permits licensed pharmacists to dispense ivermectin (a medication typically used to treat parasitic infections) without requiring a prescription from a healthcare practitioner. The order must include standardized procedures for pharmacists to follow when dispensing the medication and require pharmacists to provide patients with usage instructions. Pharmacists who dispense ivermectin according to this order will be protected from criminal, civil, and professional disciplinary actions, provided they act in a reasonably prudent manner. Pharmacists will be required to submit an annual written report detailing the number of ivermectin doses dispensed. The executive commissioner and the Texas State Board of Pharmacy are authorized to adopt rules implementing this new section, and the commissioner who issues the statewide order cannot be subject to liability or disciplinary action for doing so. The bill will take effect 91 days after the end of the legislative session, and the commissioner is instructed to issue the statewide order as soon as practicable after the act's effective date.
