This bill, known as the "New York Fundamental Artificial Intelligence Requirements in (FAIR) News Act," aims to ensure transparency in news media by requiring disclosure when content is substantially created using generative artificial intelligence, which refers to AI models that can produce synthetic content like text, images, or audio. The act acknowledges that New York is a major news hub and that generative AI can produce content that may contain inaccuracies or plagiarism, thereby undermining public trust and potentially harming human journalists. Therefore, it mandates that any news media content disseminated in New York that is significantly generated by such AI must clearly indicate this fact, either through a visible imprint on the content or a verbal announcement at the beginning of audio content, with an exception for content eligible for copyright registration. The Attorney General is empowered to enforce these provisions, with penalties of $1,000 for a first offense and $5,000 for subsequent offenses.
