This bill modifies the existing law in Michigan regarding the crime of making a terrorist threat or a false report of terrorism, specifically amending Section 543m of the Michigan Penal Code. The changes broaden the scope of what constitutes a terrorist threat by allowing prosecution if someone makes a threat and communicates it knowing it would be viewed as threatening violence, or if they make such a threat with "reckless disregard," meaning they consciously ignore a significant and unjustified risk that their communication would be seen as threatening violence. The bill also clarifies that making a false report of terrorism is a crime if done knowingly and with the understanding that the report is false. Importantly, it states that a person cannot use the defense that they lacked the intent or ability to actually commit the act of terrorism. Violating this section remains a felony, punishable by up to 20 years in prison or a $20,000 fine, or both.
