This bill modifies Section 573.001 of the Local Government Code to expand the counties and districts subject to stormwater management regulations. Specifically, the bill removes the previous population threshold of 800,000 for counties and instead adds two new criteria: counties that contain a portion of the Edwards Aquifer or counties located wholly or partly within the Hill Country Priority Groundwater Management Area. The bill also maintains existing provisions for counties with populations of 2.8 million or more, districts with boundaries coterminous with such counties and authorized to provide stormwater drainage and flood control facilities, and counties with over 1.3 million population whose primary drinking water source is an underground aquifer. The bill would take effect immediately if it receives a two-thirds vote in both legislative houses; otherwise, it will take effect 91 days after the end of the legislative session. The changes aim to broaden the regulatory scope for stormwater management in specific Texas counties with important water resources.
