AI Summary
This bill amends the Code of Criminal Procedure of 1963 to expand judicial discretion in denying pretrial release for defendants charged with felonies. Specifically, the bill adds a new subsection that allows courts to deny pretrial release to felony defendants at their discretion, regardless of previous limitations. If a court chooses to deny pretrial release under this new provision, it must provide a written explanation for its decision. The bill maintains existing provisions that require courts to consider various factors when determining whether a defendant poses a threat to public safety, including the nature of the charged offense, the defendant's criminal history, and potential risks to specific individuals. The legislation aims to give judges more flexibility in making pretrial release decisions for felony cases, while still requiring transparent reasoning for any denial of release. This change represents a significant modification to existing pretrial release procedures, potentially making it easier for courts to keep certain felony defendants in custody pending trial.
