This bill establishes a simplified procedure for the City of Marlborough to lay out and accept subdivision roads as public ways, which deviates from standard state laws governing road acceptance. Under this new process, the city's planning board must first hold a public hearing with at least 7 days' notice to abutting property owners via mail and newspaper publication or city clerk's bulletin board. Within 21 days after the hearing, the planning board prepares a written certification confirming that the subdivision road has been constructed according to an approved plan, detailing municipal easements. The city council must then hold a meeting within 45 days to consider whether accepting the road is in the public interest. If the city council votes in favor by majority, they will adopt an order of acceptance to be recorded at the registry of deeds within 90 days. Upon recordation, the city automatically gains full ownership of the road and associated easements, with no additional compensation required for property owners.
