The review must consider factors such as national security implications, technological leadership, potential military applications, human rights risks, technology availability from alternative sources, and economic impacts. After receiving executive branch approval, the export must then be specifically approved by Congress through a joint resolution. The bill defines "advanced AI semiconductors" using precise technical performance thresholds and broadly defines the "People's Republic of China" to include the geographic territory and entities controlled by the Chinese government or Communist Party. Certain humanitarian, diplomatic, and repair-related exports are exempted from these requirements. The legislation is designed to prevent the transfer of cutting-edge semiconductor technology that could potentially enhance China's military capabilities or technological competitiveness, and it is set to expire three years after its enactment.
