This bill allows pharmacists and pharmacy interns to dispense ivermectin without a prescription to individuals 18 years or older, subject to specific protocols and requirements. The bill establishes that prescribers (including nurse-midwives, nurse practitioners, physicians, and physician assistants) can create protocols for dispensing the drug, which must include a risk assessment tool, a standardized fact sheet about ivermectin's uses and risks, and guidelines for dispensing. Pharmacists must provide the drug or refer the individual to a pharmacy that can, and they may charge an administrative fee for the service. The bill protects pharmacists and prescribers from criminal prosecution and civil liability when acting in good faith, except in cases of gross negligence or willful misconduct. Additionally, pharmacists are required to inform the patient's primary care provider about the dispensing as soon as practicable. The state board of pharmacy, in consultation with the medical board and board of nursing, will develop specific rules for implementing these protocols, ensuring a structured approach to over-the-counter ivermectin dispensing.
