This bill creates a new criminal offense of trespassing on or near school or day-care center property by establishing specific conditions under which a person can be charged with a Class A misdemeanor. The law defines school or day-care center property as all land and buildings owned or leased by a school or day-care center where an activity is being conducted, and includes public property within 250 feet of such property. A person can be charged if they enter or remain on the property without a legitimate reason (such as having a child at the school or having written permission), engage in disruptive, threatening, or harassing conduct toward students, employees, or school operations, receive a reasonable request to leave from an administrator or security personnel, and then fail to depart. The bill provides clear definitions for terms like "school" (including private and public elementary or secondary schools) and "day-care center" (as defined in the Human Resources Code). If the conduct also constitutes another criminal offense, the individual can be prosecuted under this new section, the other section, or both. The law is set to take effect on December 1, 2025, and aims to protect school and day-care environments from unwanted or potentially dangerous intrusions.
