This bill amends the New York Public Service Law to prevent electric and gas corporations from increasing charges to most ratepayers as a result of costs associated with building or operating data centers and semiconductor fabrication plants. Specifically, the bill prohibits utilities from passing along infrastructure or capital expenditure costs to general customers, with the exception that such costs can only be charged to ratepayers who are directly involved with or associated with the specific data center or semiconductor plant being developed. This means that if a utility incurs additional expenses from constructing or maintaining infrastructure for a new data center, it cannot spread those costs across all of its customers, but must limit any additional charges to those customers who are directly connected to or benefiting from the new facility. The bill will take effect 60 days after becoming law, and regulatory agencies are authorized to prepare implementation rules in advance of the effective date.
