This bill, known as the Healthcare Workforce Resilience Act, aims to address healthcare professional shortages by recapturing unused employment-based immigrant visas for nurses and physicians. Specifically, the bill will make available up to 40,000 additional immigrant visas over three years, with 25,000 reserved for professional nurses and 15,000 for physicians. These visas will be exempt from per-country numerical limitations and will be issued based on the original priority date of the visa petition. The bill requires employers to attest that hiring these immigrant healthcare professionals will not displace U.S. workers. To expedite the process, the Department of Homeland Security and the Department of State must provide premium processing for these visa applications without charging additional fees, and must quickly ship and process petitions. Family members of these healthcare professionals will also be eligible for visas from the same pool of recaptured visas, without counting against the total nurse and physician visa allocation. The visas can only be used if they are not immediately available through standard worldwide and per-country visa allocations, and the number of recaptured visas will be reduced each fiscal year by the number of visas actually used under this provision.
