Bill Summary

AN ACT to amend the civil practice law and rules and the criminal procedure law, in relation to requiring disclosure of use of generative artificial intelligence

AI Summary

This bill requires comprehensive disclosure and consent procedures for the use of generative artificial intelligence (AI) in legal contexts across civil and criminal proceedings in New York. The legislation defines generative AI broadly as machine learning technology capable of performing tasks with minimal human oversight, including systems that can learn, adapt, and mimic human-like cognitive processes. Under the proposed law, courts must inform lawyers and self-represented litigants about the potential risks of using generative AI in legal research, document review, and document creation. Before using generative AI, lawyers must obtain informed consent from their clients or criminal defendants after warning them about potential dangers. Any document drafted with generative AI assistance must be accompanied by a separate affidavit disclosing its use and certifying that a human has thoroughly reviewed the content for accuracy, including verifying case citations. Conversely, documents not using generative AI must also include an affidavit stating as much. The bill amends both civil procedure rules and criminal procedure law to ensure transparency and maintain the integrity of legal document preparation, with the new regulations taking effect 90 days after becoming law.
