AN ACT to amend the general business law, in relation to requiring search engines inform users when showing information which was generated using artificial intelligence

This bill requires search engines to disclose when the information they display is generated by artificial intelligence (AI). The bill defines AI as a machine-based system that can make predictions, recommendations, or decisions by using machine and human-based inputs to perceive and analyze environments, and then use model inference to generate options. Specifically, when a search engine shows AI-generated content, it must inform users in two ways: first, by displaying a clear, plain-language notice directly above the information in the same font size, and second, by placing a watermark across the AI-generated content. The purpose of these requirements is to increase transparency and help users understand when they are viewing information created by AI rather than human-written content. If a search engine fails to comply with these disclosure requirements, they can be subject to a civil penalty of up to $5,000. The law would go into effect 90 days after it is signed, giving search engines time to implement the necessary disclosures.
