This bill modifies the procedure for approving local watercraft ordinances by changing how the Michigan Department of Natural Resources (DNR) investigates and responds to requests for special rules on water bodies. Under the new provisions, if a request concerns a lake without public access and is supported by a petition signed by 75% or more of the riparian property owners, the DNR must grant the request and allow the local political subdivision to adopt and enforce the ordinance without going through the standard investigation process. For other water bodies, the DNR will continue to conduct a comprehensive investigation considering factors such as safety, water body characteristics, navigation, user conflicts, and historical uses. The bill also streamlines the resolution process for local governments, allowing them to adopt a resolution after a public hearing to request a special local ordinance. If the DNR determines a special rule is not needed, the political subdivision can appeal the decision to the DNR director, who will make the final agency decision. The changes aim to provide more flexibility for local governments while maintaining a structured review process for watercraft regulations.
