This bill amends the Youth Rehabilitation Services Act to modify requirements for DNA sample collection from public wards (youth under the supervision of a youth agency) who have been convicted of or found responsible for certain criminal offenses. The bill updates language around prostitution-related offenses, replacing terms like "prostitution" and "house of ill fame" with "commercial sexual activity" and broadening the scope of related offenses. The bill requires public wards to provide DNA samples and genetic markers before being placed in a community setting or discharged from wardship if they have committed specific crimes, including sexual offenses, child enticement, indecent exposure, and commercial sexual activity-related offenses. The youth agency can collect these samples without the ward's consent and without a hearing, and the samples can only be disclosed in limited circumstances such as criminal justice identification, court proceedings, or academic research with personal identifiers removed. Public wards found responsible for such offenses must pay a $60 assessment to help cover the costs of DNA processing. The bill is tied to another house bill and will take effect 90 days after enactment, contingent on the passage of the related legislation.
